AGREEMENT TO TERMS

These Terms and Conditions constitute a legally binding agreement made between you and Critical Endeavors, LLC, doing business as Functional Mentoring, concerning your access to and use of the websites https://functionalmentoring.com, https://functionalmentoringacademy.com, and https://functionalmentoring.academy.

INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Site and all content, including text, graphics, videos, frameworks, methodologies, and materials, are owned by Critical Endeavors, LLC and are protected by copyright, trademark, and other laws.

USER REPRESENTATIONS

By using the Site, you represent that you are at least 18 years of age, have the legal capacity to agree to these Terms, and will comply with all applicable laws and regulations.

USER REGISTRATION

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.

PROHIBITED ACTIVITIES

You may not use the Site for any unlawful purpose, to infringe intellectual property rights, to harass or harm others, to submit false information, or to attempt unauthorized access to systems or data.

USER GENERATED CONTRIBUTIONS

The Site may allow you to submit content. You are solely responsible for your contributions and represent that you own or control all rights to the content you submit.

CONTRIBUTION LICENSE

By submitting content, you grant Critical Endeavors, LLC a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute such content in connection with the Site.

GUIDELINES FOR REVIEWS

Reviews must be truthful, respectful, and based on genuine experiences. We reserve the right to remove reviews that violate these Terms.

PRODUCTS AND SERVICES

The Site may offer programs, courses, coaching services, memberships, or other offerings for sale. Each offering may be governed by additional terms presented at the time of purchase.

If you engage in coaching services, your relationship with Functional Mentoring will be governed by a separate written Coaching Agreement and Informed Consent document. That agreement controls the coaching relationship, confidentiality expectations, scheduling, billing, and scope of services. These website Terms govern only your use of the Site and do not replace or modify any signed coaching agreement.

SITE MANAGEMENT

We reserve the right to manage, modify, or discontinue the Site to protect our rights and ensure proper operation.

THIRD-PARTY WEBSITES AND CONTENT

The Site may contain links to third-party websites or content. We are not responsible for the availability, accuracy, or content of third-party websites.

PROFESSIONAL, MEDICAL, AND MENTAL HEALTH DISCLAIMER

The Site and all content are provided on an as-is and as-available basis. No warranties are made regarding accuracy, completeness, or reliability.

Coaching, educational, and informational content provided through the Site is not medical advice, mental health treatment, psychotherapy, counseling, legal advice, financial advice, or any other regulated professional service. Although Christopher J. Colombo, MD is a licensed physician, no physician-patient relationship is created through use of this Site or participation in coaching services. Coaching is distinct from medical care, psychotherapy, and mental health treatment.

You are encouraged to seek appropriate medical, mental health, or other licensed professional support for any health-related or psychological concerns.

Mandatory Reporting Notice: Although coaching services do not constitute medical or mental health treatment, Christopher J. Colombo, MD remains a mandatory reporter under the laws of the State of Washington. Information disclosed that triggers mandatory reporting obligations under Washington law may be reported to appropriate authorities as required.

Confidentiality of coaching communications is governed by the applicable Coaching Agreement and Informed Consent document and is subject to ethical obligations and applicable law.

RESULTS AND TESTIMONIALS DISCLAIMER

The Site may include testimonials, case studies, or descriptions of client experiences. These statements reflect the individual experiences of those clients and are not intended to represent or guarantee that any other user will achieve the same or similar results.

Results from coaching, training, or educational services vary based on individual circumstances, effort, commitment, background, and numerous external factors. No specific outcomes, professional advancement, personal development results, or performance improvements are guaranteed.

You acknowledge that you are solely responsible for your decisions, actions, and results arising from your use of the Site and any services or content provided.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, the total liability of Critical Endeavors, LLC shall be limited to the lesser of one hundred dollars ($100) or the amount paid by you. For subscription-based offerings, liability is limited to three months of payments.

INDEMNIFICATION

You agree to indemnify and hold harmless Critical Endeavors, LLC from any claims arising out of your use of the Site or violation of these Terms.

DISPUTE RESOLUTION

The parties agree to attempt informal negotiation before initiating arbitration. Any arbitration shall take place in Pierce County, Washington. Each party shall be responsible for its own arbitration fees.

GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the State of Washington.

TERM AND TERMINATION

These Terms remain in effect while you use the Site. We may suspend or terminate access at our discretion. Coaching relationships may be terminated by either party pursuant to the terms of the applicable Coaching Agreement.

MODIFICATIONS AND INTERRUPTIONS

We reserve the right to modify or discontinue the Site or these Terms at any time without notice.

ELECTRONIC COMMUNICATIONS

You consent to receive electronic communications and agree that such communications satisfy legal requirements.

MISCELLANEOUS

These Terms constitute the entire agreement between you and Critical Endeavors, LLC. If any provision is held unenforceable, the remaining provisions shall remain in effect.

ETHICAL STANDARDS

Functional Mentoring adheres to the International Coaching Federation (ICF) Code of Ethics.

Nothing in this section creates a third-party beneficiary relationship or alters the governing law or dispute resolution provisions set forth in these Terms.
